Terms of Service

Please read these Terms of Service ("Terms") carefully before accessing or using any Services provided by Synergy Incorporated ("Synergy," "we," "us," or "our"). By accessing our website, enrolling in a training program, or subscribing to any of our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

Section 01

Description of Services

Synergy provides sales and communication training programs, coaching, and related resources for home service industry professionals, including HVAC, plumbing, electrical, and roofing businesses (collectively, the "Services"). Services are delivered through our website, our online training platform (LightspeedVT), live virtual sessions, email, and other digital channels.

We reserve the right to modify, suspend, or discontinue any part of our Services at any time. We will provide reasonable notice of material changes where possible.

Section 02

Eligibility

Our Services are intended for business owners, managers, and sales professionals in the trades industry. By using our Services, you represent that:

  • You are at least 18 years of age;
  • You have the legal authority to enter into these Terms on behalf of yourself or your business;
  • Your use of the Services does not violate any applicable law or regulation.
Section 03

Accounts and Access

Access to certain Services requires creating an account on our training platform (LightspeedVT). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to:

  • Provide accurate and complete information when creating your account;
  • Notify us immediately of any unauthorized use of your account;
  • Not share your login credentials with any third party;
  • Not allow multiple individuals to use a single account simultaneously.

Synergy reserves the right to suspend or terminate accounts that violate these Terms, are associated with fraudulent activity, or that have been inactive for an extended period.

Section 04

Subscription and Billing

Access to Synergy's training programs is billed on a weekly subscription basis. By enrolling, you authorize Synergy to charge your payment method on a recurring weekly basis until you cancel.

  • Billing Cycle. Subscriptions renew automatically each week on the same day of the week as your original enrollment date.
  • Payment Processing. Payments are processed securely through Stripe. We do not store full payment card information.
  • Price Changes. We reserve the right to adjust subscription pricing. We will provide at least 14 days' written notice before any price change takes effect on your account.
  • Failed Payments. If a payment fails, we may retry the charge and may suspend access to your account until the outstanding balance is resolved.

Cancellation and Refunds

You may cancel your subscription at any time by contacting us at info@synergylearningsystems.net or by calling (720) 425-1095. Cancellation takes effect at the end of your current billing week. You will retain access to the platform through the end of the period you have already paid for.

Refund Policy Synergy does not offer automatic refunds. All refund requests are reviewed on a case-by-case basis. If you believe you are entitled to a refund, contact us directly and we will work with you to reach a fair resolution. We are committed to standing behind the value of our training.

Factors we consider in refund reviews include: length of time since charge, level of platform engagement, and the specific circumstances of the request. Synergy reserves the right to approve or deny refund requests at its sole discretion.

Section 06

Intellectual Property

All content provided through Synergy's Services — including training materials, videos, scripts, frameworks, workbooks, and the "07 Foundations of Effective Communication" system — is the exclusive intellectual property of Synergy Incorporated and is protected by applicable copyright, trademark, and trade secret laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to access and use Synergy's training content for your own internal business purposes. You may not:

  • Reproduce, distribute, resell, or sublicense any Synergy content;
  • Share login credentials or platform access with individuals outside your organization;
  • Use Synergy's frameworks, scripts, or materials in competing training products or services;
  • Record, screenshot, or capture training sessions for distribution without written permission.

Violation of these terms may result in immediate account termination and legal action.

Section 07

Acceptable Use

You agree to use Synergy's Services in a professional and lawful manner. You may not:

  • Use the Services for any unlawful purpose or in violation of any applicable regulation;
  • Attempt to gain unauthorized access to any part of the platform or our systems;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Upload or transmit any content that is harmful, defamatory, or infringes on the rights of others;
  • Use automated tools, bots, or scrapers to extract content from the platform.

Synergy reserves the right to investigate and take appropriate action against any suspected violations, including suspension or termination of access without refund.

Section 08

SMS Communications

By providing your mobile number and opting in through our contact form or enrollment process, you consent to receive recurring text messages from Synergy Learning Systems, including service updates, training reminders, and promotional communications. Message and data rates may apply. Message frequency varies.

  • Reply STOP at any time to opt out. No further messages will be sent after opting out.
  • Reply HELP for assistance or contact us at info@synergylearningsystems.net.
  • Consent to receive SMS messages is not a condition of purchase.
  • We do not share your mobile number with third parties for their own marketing purposes.

Disclaimer of Warranties

Synergy's Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The Services will be uninterrupted, error-free, or free of viruses or other harmful components;
  • Any specific results or outcomes will be achieved through use of our training programs;
  • The content of our training materials will be suitable for every business situation.

Testimonials and case studies reflect the experiences of specific clients and are not a guarantee of typical or expected results. Individual outcomes depend on many factors including commitment, market conditions, and business circumstances.

Section 10

Limitation of Liability

To the fullest extent permitted by applicable law, Synergy Incorporated, its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, including lost profits, lost revenue, or lost business opportunities.

In no event shall Synergy's total liability to you for any claim arising out of these Terms or your use of the Services exceed the total amount you paid to Synergy in the three (3) months immediately preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Synergy Incorporated and its officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of or inability to use the Services;
  • Your violation of these Terms;
  • Your violation of any third-party rights, including intellectual property or privacy rights;
  • Any content you submit or transmit through the Services.
Section 12

Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Services shall first be submitted to good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in Colorado under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration against Synergy.

Section 13

Changes to These Terms

Synergy reserves the right to update or modify these Terms at any time. We will post the revised Terms with an updated "Last Updated" date. For material changes, we will provide notice by email or through the platform. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
